SHORT DESCRIPTION: TCEQ Enforcement Discretion Beginning Immediately and Ending at Midnight Tonight

INTENDED AUDIENCE: QSEs and Resource Entities with Generation Assets

DAYS AFFECTED: September 6, 2023

LONG DESCRIPTION: Due to a scarcity of reserves, ERCOT has declared an Energy Emergency Alert Level 2.  To ensure as much generation as possible is available to serve system demand, ERCOT has requested that the Texas Commission on Environmental Quality (TCEQ) exercise its enforcement discretion with respect to generator exceedances of TCEQ air permit limitations. TCEQ has communicated to ERCOT that it will use its enforcement discretion in evaluating generation facility exceedances of emission and operational permit limits to maximize generation availability.  Unless TCEQ provides notice otherwise, TCEQ’s enforcement discretion will apply beginning immediately and last until midnight tonight, September 6, 2023.

Any generation facility operator that expects to exceed its air permit limits to assist during this period shall document its activities and provide notice to Kelly Cook ([log in to unmask]), Deputy Director of Critical Infrastructure Division for TCEQ.
