SHORT DESCRIPTION: Notice of Petition in Public Utility Commission of Texas (PUC) Docket No. 56122, Petition of Electric Reliability Council of Texas, Inc. for Expedited Declaratory Order Regarding Public Utility Regulatory Act Chapter 39, Subchapter M

LONG DESCRIPTION:  Today, ERCOT has filed a petition in PUC Docket No. 56122, Petition of Electric Reliability Council of Texas, Inc. for Expedited Declaratory Order Regarding Public Utility Regulatory Act Chapter 39, Subchapter M.  In its petition, ERCOT seeks, on an expedited basis, a PUC order declaring that

(1)  The exemption from the assessment of Securitization Default Charges applicable to the City of Lubbock, acting by and through its municipally owned utility, Lubbock Power and Light, (LP&L) under PURA § 39.151(j-1) and the Debt Obligation Order issued by the PUC in PUC Docket No. 52321, Application of Electric Reliability Council of Texas, Inc. for a Debt Obligation Order Pursuant to Chapter 39, Subchapter M of the Public Utility Regulatory Act, will remain in effect for the load of end-use customers in LP&L’s service area (referred to as the Lubbock Area Load) upon the commencement of the City of Lubbock’s transition to retail competition;

(2)  ERCOT will continue to exclude LP&L from the imposition of Securitization Default Charges;

(3)  ERCOT will implement a process to exclude the load volume of Lubbock Area Load from the calculation of Securitization Default Charges; and

(4)  Qualified Scheduling Entities representing Load Serving Entities serving the Lubbock Area Load and Congestion Revenue Right (CRR) Account Holders managing CRR activity related to Lubbock Area Load are prohibited from assessing or passing through to those customers any costs or charges related to Securitization Default Charges.

ERCOT has proposed a deadline of January 22, 2024 for all interested parties to file Motions to Intervene in the PUC proceeding.  ERCOT has further proposed a January 26, 2024 deadline for filing Initial Briefs on the Merits and a February 2 deadline for filing Reply Briefs and Proposed Declaratory Orders.     

ERCOT issues this Market Notice consistent with the notice proposed in its petition, namely, issuance of a Market Notice to all wholesale Market Participants through the ERCOT Notice_General and Notice_Settlements distribution lists.
