SHORT DESCRIPTION: Qualified Scheduling Entities (QSEs) Financial Statements due by August 30, 2010
INTENDED AUDIENCE: QSE Financial Personnel
DAY AFFECTED: August 30, 2010
LONG DESCRIPTION: ERCOT Protocol Section 16.2.8 requires all QSEs to provide their own or their Guarantor's : (1) quarterly unaudited financial statements (semi-annually, if the Guarantor is foreign and rated by a rating agency acceptable to ERCOT) not later than sixty (60) days (ninety (90) days if the Guarantor is foreign and rated by a rating agency acceptable to ERCOT) after the close of the issuer's fiscal quarters; and (2) annual audited financial statements not later than one hundred twenty (120) days after the close of the issuer's fiscal year.
For QSEs/Guarantors whose fiscal quarter ended on June 30, 2010, the quarterly unaudited financial statements are due by August 30, 2010.
ACTION REQUIRED: QSEs or their Guarantor, whose quarterly unaudited financial statements are due (or past due) should provide these statements to ERCOT as soon as possible to avoid any remedial action as authorized under the Standard Form Market Participant (MP) Agreement, the ERCOT Protocols and/or the Public Utility Regulatory Act (PURA).
For all QSEs who failed to timely submit their quarterly unaudited financial statements by August 30, 2010, ERCOT will submit the names of those QSEs to the Public Utility Commission of Texas (PUCT) in an informational filing in PUCT Docket. This Notice serves as the only reminder to QSEs to submit their financial statements by the August 30, 2010 deadline.
QSE's or Guarantor's financial statements that are publicly available electronically need not be provided to ERCOT.
