NOTICE DATE: September 9, 2014
NOTICE TYPE: M-A090914-01 Legal
SHORT DESCRIPTION: Change in method of providing notice of ERCOT Petition filings with the PUCT
INTENDED AUDIENCE: All Market Participants
DAYS AFFECTED: September 9, until further notice
LONG DESCRIPTION: ERCOT will provide notice to Market Participants of ERCOT Petition filings with the Public Utility Commission of Texas (PUCT) by issuing a Market Notice to the NOTICE_LEGAL_NOTIFICATIONS Listserv.
Historically, ERCOT has provided notice to Market Participants when it files a Petition with the PUCT by sending a copy of the Petition via first-class U.S. mail to the parties of record in ERCOT's last fee case, P.U.C. Docket No. 31824, Application of the Electric Reliability Council of Texas for Approval of the ERCOT System Administration Fee, in addition to posting the Petition on the ERCOT website and circulating it to certain ERCOT email exploder lists. Because Docket No. 31824 was opened in 2005 and many of the addresses on file are no longer accurate, issuing a Market Notice via the Listserv will be a more effective method of notifying interested Market Participants of ERCOT Petition filings. Accordingly, ERCOT will no longer send copies to the parties of record in Docket No. 31824, and instead will issue a Market Notice to NOTICE_LEGAL_NOTIFICATIONS.
Market Participants that are interested in being notified of ERCOT Petition filings with the PUCT should subscribe to the NOTICE_LEGAL_NOTIFICATIONS Listserv. To subscribe to the Listserv, please visit http://lists.ercot.com.
ADDITIONAL INFORMATION: This new method for notifying Market Participants will only apply to instances in which ERCOT files a Petition (e.g., a filing regarding an amendment to the ERCOT By-laws or the appointment of an Unaffiliated Director). It will not apply to instances in which a complaint is filed with the PUCT against ERCOT. ERCOT will continue to provide notice to Market Participants of complaints filed against ERCOT in accordance with P.U.C. Proc. R. 22.251, Review of Electric Reliability Council of Texas (ERCOT) Conduct, subsection (e).
CONTACT: If a Market Participant has any questions concerning this Notice, please contact Bill Magness, ERCOT General Counsel, at (512) 225-7076 or Chad V. Seely, ERCOT Assistant General Counsel, at (512) 225-7035.
