SHORT DESCRIPTION:  Execution of New Version of ERCOT Standard Form Market Participant Agreement (SFA) as a result of Approval of Nodal Protocol Revision Request (NPRR) 612, Reduction of Cure Period Subsequent to Event of Default.
INTENDED AUDIENCE:  All ERCOT Market Participants
DAY AFFECTED:  March 2, 2015

LONG DESCRIPTION:  On December 9, 2014, the ERCOT Board of Directors (Board) approved NPRR612, Reduction of Cure Period Subsequent to Event of Default. NPRR612 reduces the cure period for failure to make payment, transfer funds, provide collateral, or designate or maintain an association with a Qualified Scheduling Entity (QSE), to one Business Day subsequent to written notification of the breach. In addition, the NPRR clarifies that an Invoice payment from available security will be considered a Late Payment per Section 16.11.6; eliminates discrepancies between Protocol and SFA language; and aligns terminology in Section 16, Registration and Qualification of Market Participants. NPRR612 becomes effective on April 1, 2015.



Because NPRR612 modifies the SFA, all Market Participants (whether Load Serving Entity (LSE), QSE, Transmission Service Provider (TSP), Distribution Service Provider (DSP), Congestion Revenue Right (CRR) Account Holder, Resource Entity, Renewable Energy Credit (REC) Account Holder or Independent Market Information System Registered Entity (IMRE)) must execute the new version of the SFA that will become effective on April 1, 2015.



As such, each Entity must execute and submit to ERCOT the attached SFA no later than March 2, 2015 in order to allow ERCOT sufficient time to counter-sign and return fully executed SFAs to each Entity by April 1, 2015. Please note that your organization's current SFA will remain in effect until March 31, 2015; at which time, it will be replaced by this new version of the SFA on April 1, 2015.



Please note that an Entity should submit one SFA for all Market Participant registrations listed above in which it participates in the ERCOT Region. For example, if ABC Company is an LSE and a QSE, ABC Company would check those two options on page one of the SFA.  If participation has changed or is anticipated to change effective April 1, 2015, the Market Participant is reminded to submit a Notice of Change of Information and/or associated Application(s) to coincide with the participation types on the new SFA.  Participation changes after April 1, 2015 requires submitting the SFA Amendment form.  Please contact your ERCOT Account Manager for assistance with registration changes.


Please fill out all of the appropriate grey shaded boxes on pages one, two and fourteen. Print the SFA and have it executed by an individual with binding authority for your organization. Please ensure you use the correct legal name of your organization and its correct DUNS Number when filling out the SFA.
