LONG DESCRIPTION: ERCOT Protocol Section
16.2.8 requires all QSEs to provide their own or their Guarantor’s
: (1) quarterly unaudited financial statements (semi-annually, if the Guarantor
is foreign and rated by a rating agency acceptable to ERCOT) not later than
sixty (60) days (ninety (90) days if the Guarantor is foreign and rated by a
rating agency acceptable to ERCOT) after the close of the issuer’s fiscal
quarters; and (2) annual audited financial statements not later than 120 days
after the close of the issuer’s fiscal year.
For QSEs/Guarantors whose fiscal
quarter ended on March 31, 2009, the quarterly financial statements were due by
May 31, 2009.
ACTION REQUIRED: QSEs or their
Guarantor, whose quarterly financial statements for 2009 are due (or past due)
should provide these statements to ERCOT as soon as possible to avoid any
remedial action as authorized under the Standard Form Market Participant (MP)
Agreement, the ERCOT Protocols and/or the Public Utility Regulatory Act
(PURA).
For all QSEs who
failed to timely submit their quarterly unaudited financial statements by May
31, 2009, ERCOT will submit the names of those QSEs to the Public Utility
Commission of Texas (PUCT) in an informational filing in PUCT Docket No. 27706 by no
later than June 15, 2009. As in past informational filings on this subject,
ERCOT does not intend to ask for any PUCT relief, but does reserve the right to
future remedies against non-compliant QSEs.
QSE’s
or Guarantor’s financial statements that are publicly available
electronically need not be provided to ERCOT.
