SHORT DESCRIPTION:  Payment on Settlement Agreement the PUCT originally entered with Enron Power Marketing Inc. (EPMI) as part of PUCT Docket No. 25968

INTENDED AUDIENCE:  QSEs with Load Ratio Share for August 2001

LONG DESCRIPTION:  The Public Utility Commission of Texas (PUCT) recently forwarded to Electric Reliability Council of Texas, Inc. (ERCOT) a sum of money ($3,226.99) relating to a Settlement Agreement the PUCT originally entered with Enron Power Marketing Inc. (EPMI) as part of PUCT Docket No. 25968, NOTICE OF INTENT TO ASSESS AN ADMINISTRATIVE PENALTY AGAINST ENRON POWER MARKETING, INC., AND REQUEST FOR REGULATORY FINDINGS PERTAINING TO FUTURE FITNESS OF EPMI, ITS OFFICERS AND DIRECTORS FOR CERTIFICATION IN THE ERCOT MARKET BASED ON ALLEGED VIOLATIONS OF TEXAS UTILITIES CODE § 39.151(d), (i), AND (0); P.U.C. SUBSTANTIVE RULES 25.200(b) AND 25.361; AND ORDER ON REHEARING IN P.U.C. DOCKET NO. 23220; PURSUANT TO P.U.C. PROCEDURAL RULE 22.246, ADMINISTRATIVE PENALTIES.

Although the PUCT entered into the Settlement Agreement with EPMI several years ago, the settlement was tied up in the Enron bankruptcy until recently.

According to the Settlement Agreement, ERCOT is to distribute monies collected from EPMI based on “load ratio share for August 2001 used by ERCOT on April 29, 2002, to distribute the balance of the System Congestion Fund, adjusted by excluding the load of TXU US Holdings Company, known in August 2001 as TXU Electric Company (“TXU Electric”).”

ADDITIONAL INFORMATION:  The money will be paid to Qualified Scheduling Entities (QSEs) if they had a non-zero Load Ratio Share (LRS) as stated above. Backup information will be provided to those entities receiving payment in the “MISCELLANEOUS” folder on Texas Market Link (TML).
