SHORT DESCRIPTION: Administration of PUC Substantive Rule 25.476, Renewable and
Green Energy Verification

LONG
DESCRIPTION: This notice is to announce the continuing administration of
PUCT Substantive Rule 25.476, Renewable and Green Energy Verification, for
which ERCOT serves as the registration agent. This rule affects owners of
generating facilities located in Texas and all retail electric providers
(REPs).
The
purpose of PUCT Substantive Rule 25.476 is to establish the procedures by which
REPs calculate and compose their renewable content pursuant to §25.475, General
Retail Electric Provider Requirements and Information Disclosures to
Residential and Small Commercial Customers, and to establish guidelines and
verification for claims of “green” products.
In
January, ERCOT will begin the 2009 data collection with the following
deadlines:
March 1, 2010 – Each owner of
Texas-based Generators shall submit to ERCOT the following data: net
generation in MWh from each of its generating units in Texas; the type of fuel
used by each of its generating units in Texas; and the MWh-weighted average
annual emissions rate, on an aggregate basis for all of its generating units in
Texas for carbon dioxide, nitrogen oxides, particulates, sulfur dioxide, and
nuclear waste. Additional
detail can be found in section 25.476 (e) (3).
March 1, 2010 – Each REP that
relies upon a supply contract with an out-of-state generator to authenticate
fuel mix shall submit a report of the facility’s annual fuel mix to
ERCOT. Additional detail
can be found in section 25.476 (f) (2).
March 15, 2010 – Each REP within
Texas that markets “green” electricity for power generated from
natural gas produced in Texas shall submit attestations to ERCOT from the
generator that the natural gas used to generate electricity supplied to the REP
was produced in Texas. Additional information can be found in section 25.476
(f) (1).
April 1, 2010 – ERCOT shall
publish the fuel mix and
environmental impact data for the preceding calendar year for each generation
owner, including the percentage of MWh generated from
each fuel source and the MWh-weighted average annual emissions rate.
Additional detail can be found in section 25.476 (e) (2).
April 1, 2010 – ERCOT shall
calculate and publish the state average fuel mix, statewide system average
emission rates for each type of emission, and a default scorecard to account
for all generated electricity not authenticated by a Renewable Energy Credit. Additional detail can be found in
section 25.476 (e) (4).
July 1, 2010 –Each REP shall
update its Electricity Facts Label for each of its products. Additional detail can be found in
section 25.476 (h).
