SHORT DESCRIPTION:  Final determination of RMR status for Valley NG Power Company LLC Units 1-3

INTENDED AUDIENCE:  ERCOT Market Participants

DAY AFFECTED:  April 26, 2010

LONG DESCRIPTION:  Valley NG Power Company LLC submitted Notices of Suspension of Operations (NSOs) for Valley Units 1, 2 and 3 on February 25, 2010. On March 17, 2010, ERCOT issued its initial determination stating that preliminary analysis indicated that all three Resources were required to support ERCOT System reliability. ERCOT also stated that, pursuant to Section 6.5.9.1(6), the initial determination was subject to modification by a final determination. ERCOT has now completed further analysis and review of other alternatives. As a result of this analysis, ERCOT is issuing its final determination stating that Valley Units 1, 2 and 3 are not required to support ERCOT System reliability. Therefore, these Resources may cease or suspend operations according to the schedule in the NSOs.
