SHORT DESCRIPTION: Notice of Termination of RMR Agreement for Spencer
Unit 5

LONG DESCRIPTION: On June 15, 2010, ERCOT Board
of Directors approved the Reliability Must-Run (RMR) exit strategy for Spencer
Unit 5. Subsequently, ERCOT provided a 90-day notice of termination to
the City of Garland that the RMR Agreement with Spencer Unit 5 will terminate effective
23:59 on September 13, 2010.
ADDITIONAL INFORMATION: ERCOT System Planning previously issued an initial
determination that City of Garland’s Spencer Units 4 and 5 were
needed for RMR Service in 2010. ERCOT System Planning completed additional studies
and confirmed that only one of the Spencer units was necessary for RMR Service
for 2010. Spencer Unit 5 was subsequently placed under an RMR Agreement, which
became effective on March 1, 2010.
