SHORT DESCRIPTION:  FERC Order 771 grants FERC access to e-Tags

INTENDED AUDIENCE:  e-Tag Authors

LONG DESCRIPTION:  On December 20, 2012, The Federal Energy Regulatory Commission (FERC) issued Order 771 in Docket No. RM11-12-000 (141 FERC ¶ 61,235).  Order 771 requires electronic tag (e-Tag) Authors (through their Agent Service) and Balancing Authorities (through their Authority Service), beginning March 15, 2013, to take appropriate steps to ensure FERC access to the e-Tags covered by this Final Rule by designating FERC as an addressee on the e-Tags.  The Final Rule requires e-Tag Authors to include FERC on the list of entities with view-only rights to e-Tags. Sink Balancing Authorities must validate the inclusion of FERC on e-Tags prior to electronic delivery to FERC.

Pursuant to a Notice issued February 1, 2013, FERC extended the requirement for Sink Balancing Authorities to validate FERC access to e-Tags until 30 days after the issuance of a FERC order that addresses certain requests for clarification, made within the requests for rehearing, related to the validation responsibility of the Sink Balancing Authority. This action only applies to the requirement that Sink Balancing Authorities validate the inclusion of FERC on e-Tags.  It does not apply to the requirement that the Balancing Authorities must electronically deliver e-Tags to an address specified by FERC, or to the requirement that e-Tag Authors must include FERC on the list of entities with view-only rights to the e-Tags. FERC denied all other requests for time extensions.  Accordingly, for all other obligations, compliance with Order 771 is required by March 15, 2013.

ACTION REQUIRED:  E-Tag Authors should review Order 771 and determine their obligations, if any, thereunder.
