SHORT DESCRIPTION:  Notice of Order Directing Transmission Service (Order) issued by the Federal Energy Regulatory Commission (FERC) resolving jurisdictional concerns arising out of operation of ERCOT-CFE Direct Current (DC) Ties

LONG DESCRIPTION:  In connection with Nodal Protocol Revision Request (NPRR) 861, Clarification of ERCOT's Authority to Protect Its Jurisdictional Status, ERCOT committed to notify its Market Participants and Corporate Members of developments concerning efforts to address jurisdictional issues associated with the ERCOT-CFE DC Ties.
On July 26, 2018, FERC granted AEP Energy Partners, Inc.'s previously filed request under section 211 of the Federal Power Act (FPA) and ordered Sharyland Utilities, L.P. (Sharyland), AEP Texas, Inc. (AEP Texas), and Electric Transmission of Texas, LLC (ETT) to provide transmission services for power flow into and out of the ERCOT Region over the existing Eagle Pass DC Tie, Laredo Variable Frequency Transmitter, and McAllen (Railroad) DC Tie.  The Order further provides that such transmission services "shall not cause ERCOT, AEP Texas, ETT, Sharyland, or any other ERCOT utility or other entity that is not already a public utility to become a 'public utility' as that term is defined by section 201 of the FPA and subject to the jurisdiction of the Commission for any purpose other than for the purpose of carrying out the provisions of section 211 of the FPA."
The Order alleviates jurisdictional concerns associated with the completion and energization of two proposed transmission projects that would interconnect, respectively, the United States and Mexico near Nogales, Arizona, and the currently disconnected Mexican national grid and Baja California system.
