SHORT DESCRIPTION: TCEQ Notice of Enforcement Discretion for Extreme Cold Weather System Event – REMAINS IN EFFECT 

INTENDED AUDIENCE: Resource Entities and QSEs with Resources

DAYS AFFECTED: February 11, 2021 until further notice

LONG DESCRIPTION: Consistent with Market Notice M-C021221-01 Operations issued on February 11, 2021, this is a courtesy reminder that the Texas Commission on Environmental Quality's (TCEQ) enforcement discretion remains in effect for generating facilities to assist during this extreme cold weather system event.   

Any generating facility that expects to exceed its air permit limits to assist during this extreme cold weather system event shall provide a notice of this action to Kelly Cook ([log in to unmask]), Deputy Director of Critical Infrastructure Division for TCEQ.  Unless TCEQ provides notice otherwise, the period of enforcement discretion will continue until ERCOT provides a Market Notice declaring that the enforcement discretion has ended.
