SHORT DESCRIPTION: Implementation of PUCT order directing ERCOT to apply failure-to-provide Settlement treatment to QSEs that failed on Ancillary Service Supply Responsibilities

LONG DESCRIPTION: On March 12, 2021, the Public Utility Commission of Texas (PUCT) issued an order in project 51812 directing ERCOT to “settle each qualified scheduling entity that failed on its ancillary service supply responsibility in accordance with ERCOT Nodal Protocol section 6.4.9.1.3, entitled Replacement of Ancillary Service Due to Failure to Provide, for a particular ancillary service for any hour of ERCOT's operating days February 14, 2021 through February 19, 2021”. Protocol Section 6.4.9.1.3 (1) states that “a QSE is considered to have failed on its Ancillary Services Supply Responsibility when ERCOT determines, in its sole discretion, that some or all of the QSE’s Resource-specific Ancillary Service capacity will not be available in Real-Time.”
To determine unavailable Ancillary Service capacity for the ODs at issue, ERCOT will compare each Qualified Scheduling Entity’s (QSE’s) Real-Time Ancillary Service Supply Responsibility per Protocol Section 4.4.7.4, Ancillary Service Supply Responsibility, during the applicable Operating Hour on the OD at issue, to the QSE’s average Real-Time telemetered Ancillary Service Responsibility for the Operating Hour across its portfolio. Paragraph (1) of Protocol Section 8.1.1.1, Ancillary Service Qualification and Testing, states, “Each QSE for the Resources that it represents may only provide Ancillary Services on those Resources for which it has met the qualification criteria.” Therefore, ERCOT will exclude any telemetered Ancillary Service Responsibility that a Resource was not qualified to provide on the ODs at issue. ERCOT will also exclude telemetered Ancillary Service Responsibility where a Resource had a telemetered Resource Status indicating inability to provide the applicable Ancillary Service on the ODs at issue. Finally, ERCOT will use a minimum threshold of 1 MWh per OD, per Ancillary Service product in determining failed quantities.
