SHORT DESCRIPTION: ERCOT's request for determination as to the applicability of the Texas Public Information Act (TPIA)

LONG DESCRIPTION: On March 1, 2021, ERCOT submitted a request for a determination from the Office of the Attorney General of Texas (OAG) as to whether the TPIA applies to ERCOT so that ERCOT has clear direction as to the applicable procedures that it should follow in processing requests for records.  In the months following, ERCOT submitted additional record requests as supplements to the OAG filing.

On May 20, 2021, ERCOT received a letter from OAG determining that ERCOT is not subject to the TPIA.  A copy of the letter is attached to this Market Notice.

ERCOT will continue to respond to record requests under the information request policy posted on the ERCOT website and in accordance with Public Utility Commission (PUC) rules as it has in the past.
