SHORT DESCRIPTION: Reminder of Upcoming Submission Period for Declarations of Completion of Generation Resource Weatherization Preparations for Resource Entities Not Submitting New Winter Weather Readiness Report

INTENDED AUDIENCE: Resource Entities with Generation Resources and Energy Storage Resources

LONG DESCRIPTION: On October 26, 2021, the Public Utility Commission of Texas (PUC) issued an order adopting new PUC Substantive Rule 25.55 (16 Tex. Admin. Code ยง 25.55).  Subsection (c)(2) of the new rule requires each Resource Entity for a Generation Resource or Energy Storage Resource to submit a winter weather readiness report (WWRR) to ERCOT and the PUC by December 1, 2021.  On November 12, 2021, ERCOT sent emails containing links to the generator WWRR forms.  The emails were sent to the Authorized Representative for each applicable Resource Entity and include instructions for submitting the form.

Under subsection (c)(5) of the new rule, an entity that timely files a WWRR will be exempt, for the 2021 calendar year, from filing the Declaration of Completion of Generation Resource Winter Weatherization Preparations (Declaration) required by ERCOT Protocol Section 3.21(3), Submission of Emergency Operations Plans, Weatherization Plans, and Declarations of Summer and Winter Weather Preparedness.  Accordingly, Resource Entities that timely submit a WWRR for a given Generation Resource or Energy Storage Resource by December 1, 2021 do not need to submit a Declaration for the 2021 winter season.

While submission of the WWRR is mandated under Rule 25.55, if a Resource Entity for any reason does not intend to comply with the Rule's requirement to submit a WWRR by the December 1, 2021 deadline, the Resource Entity would, in that case, be required to submit the Declaration required by Protocols Section 3.21(3) no later than December 1, 2021.  The Declaration requires a Resource Entity to certify that it has completed or will complete all weather preparations required by the weatherization plan for equipment critical to the reliable operation of each Generation Resource during the relevant summer or winter Peak Load Season.  Any preparations that remain incomplete at the time the Declaration is submitted must be described in an attachment to the Declaration. 

Only the Resource Entity for a registered Generation Resource may submit a Declaration on behalf of the Generation Resource.  Declarations for jointly owned Generation Resources must be submitted by the Master Owner Resource Entity.  Resource Entities may comply with the requirement to identify each Generation Resource on the Declaration form by providing the site code, rather than the individual unit code for each Generation Resource covered by the Declaration.  Each Declaration must be signed by an officer of the Resource Entity or an individual who has been authorized in writing to bind the Resource Entity. In accordance with subsection (c)(4) of Rule 25.55, any Resource Entity that fails to timely submit a WWRR for each Generation Resource and Energy Storage Resource in its portfolio by December 1, 2021 will be reported to the PUC by December 10, 2021.  ERCOT will also identify in that filing (or in a separate filing) each Resource Entity that fails to timely submit either a WWRR or a Declaration for one or more Generation Resources or Energy Storage Resources in its portfolio.

ACTION REQUIRED: If a Resource Entity does not intend to submit a WWRR by December 1, 2021, as required by new Rule 25.55, for one or more Generation Resources or Energy Storage Resources, it must submit a Declaration of Completion of Generation Resource Winter Weatherization Preparations for those Resources to ERCOT via email at [log in to unmask] no earlier than November 1, 2021 and no later than December 1, 2021.
