SHORT DESCRIPTION: Implementation Details for NPRR1073

INTENDED AUDIENCE: All Market Participants

LONG DESCRIPTION:  On January 1, 2022, the Protocol language associated with Nodal Protocol Revision Request (NPRR) 1073, Market Entry/Participation by Principals of Counter-Parties with Financial Obligations, will be implemented.

NPRR1073 defines a Principal of a Market Participant and modifies ERCOT’s market-entry-qualification and continued-participation requirements for ERCOT Counter-Parties i.e., Qualified Scheduling Entities (QSEs) and Congestion Revenue Right (CRR) Account Holders.  These revisions include changes to the application forms and processes for QSEs and CRR Account Holders. These changes also include an ongoing requirement that QSEs and CRR Account Holders be able to demonstrate to ERCOT’s reasonable satisfaction that none of the QSE's or CRR Account Holder's Principals were or are Principals of a terminated Market Participant with money remaining owed to ERCOT and an ongoing obligation to promptly notify ERCOT of any material change to the QSE's or CRR Account Holder's ability to continue to meet the applicable market-entry-qualification and continued-participation requirements.  Those requirements for QSEs are in Protocol Section 16.2.1, Criteria for Qualification as a Qualified Scheduling Entity; those requirements for CRR Account Holders are in Protocol Section 16.8.1, Criteria for Qualification as a CRR Account Holder. 

The ongoing notification obligations of a QSE or CRR Account Holder include promptly notifying ERCOT of any changes in the QSE's or CRR Account Holder's Principals.  A new form titled "Notice of Change of Principals" should be used for such notifications.  This form will be available on ERCOT’s website at http://www.ercot.com/services/rq on or before January 1, 2022.    

ADDITIONAL INFORMATION:  Pursuant to Nodal Protocol Section 21.6, Nodal Protocol Revision Implementation, ERCOT is required to provide notice as soon as practicable, but no later than ten days prior to implementation.
