SHORT DESCRIPTION: Disqualification of Load Resources Based on Critical Load Attestation

INTENDED AUDIENCE: QSEs and Resource Entities representing Load Resources

DAYS AFFECTED: January 21, 2022

LONG DESCRIPTION: As described in Market Notice M-A120921-01, Implementation Detail of NPRR1087 and Action required by Resource Entities representing Load Resource, issued on December 9, 2021, and Market Notice, M-A120921-02, Reminder: Load Resource Critical Load Attestation forms due by December 30, 2021, issued on December 20, 2021, each Resource Entity that represents an existing Load Resource was required to complete the Attestation Regarding Critical Load Status and return it to ERCOT by December 30, 2021. 

For a Load Resource to continue to provide Ancillary Services, the Resource Entity for that Resource was required to attest that:

  1. The Load Resource is not located behind an Electric Service Identifier (ESI ID) that corresponds to a Critical Load (as that term is defined in the Protocols), or
  2. It is located behind such an ESI ID, but the Load Resource itself is not the Critical Load, or
  3. It has available backup generation or another technology that will ensure the Load’s continued availability during an emergency deployment.

As a next step in this process, ERCOT will revoke the qualification status of any Load Resource for which the submitted attestation indicates that the Resource does not meet one of these conditions or for which no attestation has been submitted. This process will begin on Friday January 21, 2022. In addition, any Resource Entity seeking to register a new Load Resource will also be required to submit such an attestation as a condition of registration.
