SHORT DESCRIPTION: Notice of Petition in Public Utility Commission of Texas (PUC) Docket No. 53797, Petition to Direct Disbursement of PURA Chapter 39, Subchapter N Proceeds Designated for V247 Power Corporation

LONG DESCRIPTION: Staff of the PUC (PUC Staff) has filed a petition in PUC Docket No. 53797, Petition to Direct Disbursement of PURA Chapter 39, Subchapter N Proceeds Designated for V247 Power Corporation. In its petition, PUC Staff seeks a PUC order directing ERCOT to disburse to all parties with valid claims the proceeds from the transaction under subchapter N of chapter 39 of the Public Utility Regulatory Act (PURA)[1] that are designated for V247 Power Corporation (V247).
PUC Staff has proposed a deadline of August 15, 2022 for all interested parties to file Motions to Intervene in the PUC proceeding and respond to the petition. PUC Staff recommends that such responses should be required to (1) state whether the respondent asserts that it is entitled to any portion of the proceeds designated for V247, including the basis for this assertion; and (2) if the respondent asserts such an entitlement, (i) specify the exact dollar amount of the alleged entitlement and (ii) attach supporting evidence (e.g., invoices, receipts, and testimony).
ERCOT issues this Market Notice consistent with PUC Staff's recommendation, in its petition, that ERCOT issue a Market Notice to all wholesale Market Participants regarding the PUC proceeding.
