SHORT DESCRIPTION: Compliance with Weatherization Declaration Submission Requirement in Protocols Section 3.2.1 Not Required

LONG DESCRIPTION: The Public Utility Commission of Texas (PUCT) recently amended 16 Texas Administrative Code (TAC) § 25.55 to establish new weatherization requirements for generators and transmission facilities. Among other things, the rule requires generation entities and Transmission Service Providers (TSPs) to submit a declaration to ERCOT before each summer and winter season regarding the specified weatherization activities. ERCOT has concluded that the Commission’s new weatherization rule supersedes the weatherization-related requirements in Section 3.21 of the ERCOT Protocols, including the requirement to submit a declaration regarding completion of weatherization activities. ERCOT submitted Nodal Protocol Revision Request (NPRR) 1152 to remove those requirements. At the open meeting on September 29, 2022, the PUCT Commissioners agreed ERCOT Market Participants need not submit the declarations required by Protocols Section 3.21 in light of the approval of revised 16 TAC § 25.55. Resource Entities and TSPs must, however, submit the winter weatherization declarations required by the PUCT rule between November 1 and December 1. ERCOT will provide additional information about submission of the updated declarations in a subsequent Market Notice.
