SHORT DESCRIPTION: ERCOT Recovery Appendix filed in Brazos Electric Power Cooperative, Inc. (“Brazos”) bankruptcy case.

DAYS AFFECTED: November 11, 2022, and thereafter
LONG DESCRIPTION: On November 10, 2022, ERCOT filed the Declaration of Sean Taylor in Support of ERCOT Settlement (“Declaration”) in the Brazos bankruptcy case. Exhibit 10 to the Declaration is the ERCOT Recovery Appendix[1] which, among other things: (1) reflects the recovery option for each Eligible Market Participant based on the returned Eligible Market Participant Election Notices; (2) defines the payment schedule for each Eligible Market Participant; and (3) identifies which of the Eligible Market Participants electing the Market Participant Deferred Cash Recovery elected to opt out of the release in Article IV.G.2 of the Plan.
The Plan remains subject to court approval. The ERCOT Recovery Appendix should not be considered final absent an order from the Bankruptcy Court confirming the Plan. The confirmation hearing on the Plan is scheduled for November 14, 2022.
