SHORT DESCRIPTION: Reminder of Upcoming Deadline for Reporting and Attestation Regarding the Purchase of Critical Electric Grid Equipment (CEGE) and Critical Electric Grid Services (CEGS)

LONG DESCRIPTION: Nodal Protocol Revision Request (NPRR) 1199, Implementation of Lone Star Infrastructure Protection Act (LSIPA) Requirements, became effective on May 1, 2024. NPRR 1199 revised several of ERCOT’s Nodal Protocols to reflect new requirements added to the LSIPA as part of Senate Bill (SB) 2013 during the 88th regular legislative session.

NPRR 1199 added a requirement in ERCOT Protocols, Section 16.1.4(2), that requires Market Participants to submit an initial report and attestation, using Section 23 Form S, identifying any purchase, lease, or receipt of any CEGE or CEGS that the Market Participant knows to be from an LSIPA Designated Company or LSIPA Designated Country. ERCOT Protocols Section 16.1.4(2)(b) requires Market Participants to submit its initial report and attestation for CEGE or CEGS purchases made between June 8, 2018 through June 18, 2021, to ERCOT by December 15, 2024.

Please complete the attestation form attached to this notice and return the executed attestation to ERCOT via email to: [log in to unmask].  Executed attestations must be received by ERCOT no later than December 15, 2024.

ERCOT is in the process of finalizing an online portal for Market Participants to submit LSIPA Attestation in lieu of sending an email to [log in to unmask] ERCOT anticipates the online portal will be available for submissions before the December 15, 2024 deadline. ERCOT will send out additional communications, which will include online portal instructions, if the online portal will be available for submissions before the December 15, 2024 deadline.

ACTION REQUIRED: Submit a properly completed attestation to ERCOT by December 15, 2024 for CEGE or CEGS purchases made between June 8, 2018 through June 18, 2021.
